Licensing Agreement
Scope
This agreement applies when you receive a license to use one or more images from the AlaskaPhoto Archive. A license is granted only upon written confirmation (email or signed agreement) from AlaskaPhoto. Browsing the site or downloading web-resolution images with attribution does not constitute a license for commercial or institutional use.
Rights Granted
A license specifies: the images covered; the type of use (editorial, educational, institutional, commercial, etc.); the geographic and temporal scope; and any exclusivity. Rights are limited to what is expressly granted. All other rights remain with AlaskaPhoto or the credited photographer.
Restrictions
Unless explicitly permitted: do not sublicense or transfer rights; do not use images for AI training or data mining; do not alter metadata or remove attribution; do not use images in a defamatory or misleading manner; do not imply endorsement. Editorial use must be in context; commercial use must match the licensed scope.
Attribution
Attribution is required in all cases. Format: 'Photo: [Photographer Name] / AlaskaPhoto Archive' or as specified in your license. For print, place credit adjacent to the image or in credits. For digital, include in caption or credits.
Indemnification
Licensees indemnify and hold harmless AlaskaPhoto and its photographers from claims arising from the licensee's use of licensed images, including but not limited to misuse, misattribution, or claims by third parties related to the use.
Termination
We may terminate a license for breach of these terms. Upon termination, you must cease use and, where practicable, remove licensed images from circulation. Survival of certain clauses (indemnification, limitation of liability) may apply as stated in the license.
Governing Law
Licenses are governed by the laws of the State of Alaska and the United States. Disputes are subject to the exclusive jurisdiction of courts in Alaska.
